A sentencing judge who refers to a criminal record both in general sentencing remarks and when noting the provisions of s 21A does not necessarily take the record into account twice; the second reference may merely indicate that the record has already been dealt with. An insignificant error in a victim impact statement will not vitiate a sentence where it is clear the judge sentenced on the correct factual basis.
