Wholly concurrent sentences for multiple domestic violence assaults committed over a two-week period against the same victim, where the offender has an extensive history of violent offences of a like kind committed in breach of parole, will be manifestly inadequate. Evidence of actual bodily harm is inadmissible in sentencing proceedings for common assault under s 61 of the Crimes Act 1900 (NSW). Prior criminal history must not be used to increase the objective seriousness of the offence but may be used to show a continuing attitude of disobedience warranting more severe penalty.
