A Griffiths remand under s 11 of the Crimes (Sentencing Procedure) Act 1999 is inappropriate for serious offences of aggravated sexual intercourse without consent against a child where the objective criminality requires significant full-time custodial sentences, even where the offender has strong subjective features and is assessed as suitable for a community-based treatment program. Rehabilitation must not be treated as the decisive sentencing factor to the exclusion of other purposes of sentencing.
