The standard non-parole period provisions must not be applied in isolation from traditional sentencing considerations. Where a sentencing judge has treated the standard non-parole period as controlling and adjusted it only by reference to s 21A factors, the sentence must be set aside and the offender resentenced. For deemed supply of a large commercial quantity of MDMA, a substantial street dealer operating as a principal in wholesale and retail supply, but not at the apex of the supply chain, falls in the middle of the range of objective seriousness.
