Where the endorsement on the back of an indictment is ambiguous as to which of two available statutory alternative offences was the subject of a plea, the ambiguity must be resolved in favour of the offender, and the sentence must be assessed against the less serious offence. A sentence imposed on a juvenile co-offender in the Children's Court is relevant to parity considerations for an adult co-offender, but where the Children's Court sentence is so inadequate, no justifiable sense of grievance arises.
