The parity principle in sentencing does not extend to correcting disparities arising from the prosecutorial charging process. A sense of grievance about being charged with a more serious offence than a co-offender is not a 'justifiable sense of grievance' within the meaning of Lowe and Postiglione. Where there is an extremely wide divergence between the offences charged against co-offenders, it is difficult if not impossible to apply parity considerations. The question whether parity can apply where co-offenders are charged with different but less divergent offences was left open.
