An attempt to receive drugs for supply is not necessarily less objectively serious than a completed offence of supply, given the breadth of the statutory definition of 'supply' in s 3 of the Drug Misuse and Trafficking Act 1985 (NSW); the objective seriousness of an attempt offence depends on the particular facts. A co-offender's equivalent sentence does not demonstrate manifest excess where the co-offender received a discount for assistance to authorities and the sentence was subsumed within a longer sentence for another offence.
