A plea of guilty to an offence on the basis of joint criminal enterprise necessarily incorporates an admission of knowledge of the essential elements of the enterprise, including the presence of a weapon. The maximum 25% discount for a guilty plea is not available where the plea was entered ten months after the offence and the offender subsequently sought to withdraw it. The Court's residual discretion in Crown appeals may be exercised to dismiss the appeal notwithstanding demonstrated sentencing errors, where the offender has demonstrated rehabilitation in custody.
