When assessing whether false or misleading information in an administrator's report justifies termination of a DOCA, the critical question is how important the corrected information would likely have been to creditors' voting decisions. Where corrected information would have shown no return to non-priority creditors, that is highly material. A disputed creditor's application for termination should not be refused merely because the debt is disputed; the weight of that factor depends on the apparent strength of the dispute. The court may use s 447A to disapply Regulation 5.3A.07 to prevent deed administrators from automatically becoming liquidators upon termination.
