A magistrate cannot refuse to hear a renewed application to withdraw a guilty plea merely because the application has been previously determined; the magistrate must at least inquire whether there is significant new material justifying a fresh hearing. An application to withdraw a guilty plea cannot properly be determined without evidence from the defendant as to the circumstances in which the plea was entered. A solicitor's submissions from the bar table are insufficient where the integrity of the plea depends on the defendant's knowledge, understanding, and the circumstances of the plea.
