The requirement in Brodyn v Davenport that an adjudication determination must amount to a bona fide attempt to exercise the relevant power means the adjudicator must make an effort to understand and deal with the issues in the discharge of the statutory function; it does not refer to dishonesty. An adjudicator who fails to consider the parties' submissions to understand the real dispute, and instead dismisses submissions on an erroneous basis without engaging with the substance of the dispute, has not attempted in good faith to exercise the statutory power, rendering the determination void.
