In windfall equity cases (as distinct from proprietary estoppel), the remedy is assessed by reference to the unconscionably retained windfall — the increased value of the defendant's property — not by capitalising the plaintiff's lost expectation of future accommodation. Benefits already received by the plaintiff (such as rent-free occupation) are offset against expenditure in assessing detriment. The loss of future accommodation is not a relevant detriment, being a consequence of the arrangement's failure rather than an act done in reliance on the arrangement.
