Attempted murder of children by a parent in the context of relationship breakdown ordinarily calls for an actual custodial sentence. A non-custodial sentence is justified only where the offender was suffering from a serious mental condition falling short of unsoundness of mind. An adjustment disorder precipitated by marital breakdown does not constitute such a serious mental condition. A head sentence of six years with eligibility for release after 15 months is within range for three counts of attempted murder by carbon monoxide poisoning where the offender desisted, had no prior criminal history, and pleaded guilty early.
