A corporation that approves advertising material prepared by a third party which conveys the corporation's own views and opinions engages in 'conduct' for the purposes of s 52 of the Trade Practices Act, even where the corporation did not itself publish the material and is referred to only in the third person. The third party publisher serves as a 'convenient medium' for the corporation's own representations. The phrase 'guaranteed success' in commercial advertising is not mere puffery but an actionable representation. Under s 51A(2), the deeming provision continues to operate unless the representor adduces evidence that actually tends to establish reasonable grounds for the representation.
