Where a parent transfers property to a child pursuant to a joint endeavour dependent on a continuing family relationship (such as a granny flat arrangement with care obligations), and that relationship fails without attributable fault, a constructive trust may be imposed to reflect the parent's capital contributions, displacing the presumption of advancement. The constructive trust doctrine from Muschinski v Dodds and Baumgartner v Baumgartner is not confined to de facto couples but extends to parent-child and other family relationships.
