Section 59(2)(b) of the Personal Injuries Proceedings Act 2002 (Qld) confers a general discretion to extend time for commencing proceedings after the limitation period, provided a complying notice of claim was given within the limitation period; the application for leave need not itself be made within the limitation period. Section 77D does not exclude the operation of s 59 for pre-18 June 2002 injuries. In exercising the discretion, the court must consider the purposes of the Act and the general considerations relevant to extension of limitation periods discussed in Brisbane South Regional Health Authority v Taylor.
