The defence of honest claim of right under s 22(2) of the Criminal Code 1899 (Qld) is available to a person who acts with respect to property in the honest belief that she is authorised to do so by a person who claims rights over that property. The defence is not confined to persons who claim a proprietary or possessory right personal to themselves. Cross-examination on irrelevant matters (such as GST obligations) that carries a prejudicial suggestion of fraud may not be cured by a judicial direction short of directing the jury to disregard the cross-examination entirely.
