The maximum penalty of five years for attempted fraud is not appropriate where the scheme was bound to be revealed as fraudulent and actual losses were modest ($27,353.98), even for a recidivist offender with significant prior history. Where an activated suspended sentence is to be served cumulatively with new sentences, the suspended sentence should be served first, and any parole recommendation applies to the total period of imprisonment.
