An offer demanding the entirety of the relief sought in a claim plus costs does not constitute an 'offer to settle' under r 360 UCPR (Qld) and will not trigger the entitlement to indemnity costs. Plaintiffs in 'all or nothing' cases who wish to invoke r 360 must offer some genuine concession, such as a reduction in costs or (in specific performance cases) acceptance of less than the contracted price. A plaintiff facing a spurious defence may still seek indemnity costs in the Court's general discretion, independent of r 360.
