For dangerous operation of a vehicle causing grievous bodily harm with a BAC just over .15%, where the dangerous driving was deliberate but over a very short distance, the offender had no prior criminal history or drink driving convictions, pleaded guilty, and demonstrated remorse, the appropriate head sentence is towards the bottom of the three to four year range. A non-suspended period of 10 months was appropriate in such circumstances. Relevant sentencing factors include the BAC, duration and nature of dangerous driving, whether the driving was deliberate, prior traffic and criminal history, plea, cooperation, remorse, and personal circumstances.
