A verdict entered in favour of a tortfeasor in an action brought by an injured plaintiff under s.93 of the Transport Accident Act 1986 does not extinguish or diminish the Transport Accident Commission's statutory right of indemnity under s.104(1). The statutory right of indemnity is independent of the injured person's cause of action and depends on legal liability at the time of the injury regardless of s.93.
