A pooling order made under s.601EE of the Corporations Act does not override the statutory priority scheme under s.556 or the equitable lien of a liquidator over assets he has realised. An administrator's statutory lien under s.443F attaches only to the property of the company to which the administrator was appointed and cannot extend to assets of other companies in a group by virtue of a pooling order. Where a liquidator realises assets of companies formerly under administration, the liquidator has first claim on those funds by virtue of his equitable lien.
