A sentencing judge may not sentence a co-offender on the basis that the co-offender was guilty of uncharged conduct in another jurisdiction, although such conduct may be taken into account in a general contextual and background way. Parity comparisons must be based on the role and facts admissible before the sentencing court, not on uncharged conduct.
