When a court imposes a cumulative sentence for a prison offence under s 16(3) of the Sentencing Act 1991, it must also fix a new single non-parole period under s 14, dating from the commencement of the original sentence. The distinction between a head sentence (which is the sentence of imprisonment subject to cumulation) and a non-parole period (which is merely the period of ineligibility for parole) must be maintained. Violence within the prison system is to be treated with particular seriousness, and the existence of a separate gaol culture does not mitigate the use of force.
