Expectation damages (lost profits calculated on the assumption that representations were true) are not recoverable under s 82 of the Trade Practices Act where the representations do not amount to contractual warranties; the appropriate measure is reliance loss. Common law affirmation of a contract induced by misleading conduct does not automatically bar relief under s 87 of the Act; it is merely a discretionary consideration. Entire agreement and voiding clauses in contracts do not preclude Trade Practices Act remedies where the party was unaware of the misleading conduct at the time of contracting.
