The mathematical process of working backwards from an imposed sentence to reconstruct a notional starting point, and then arguing the starting point exceeds the maximum or is otherwise excessive, is misconceived and will not succeed on appeal. The appellate court's task is to assess whether the final sentence imposed is manifestly excessive, not to audit the arithmetic of the discount. Cumulative sentences remain appropriate for discrete offences of different character even when arising from a single incident.
