An employer may discharge its non-delegable duty to provide a safe system of work by appointing a competent and experienced employee to be in charge of the work team with authority to cease work in unsafe conditions, rather than directly supervising operations. A person who engages an independent contractor owes a duty of care to the contractor's employees and may be liable in negligence for creating a foreseeable risk of injury, even where the employer or the injured employee could have intervened to avert the harm.
