A magistrate sentencing on summary conviction must not adopt a starting-point sentence that exceeds the maximum penalty available under summary jurisdiction, even when applying sentencing guidance from superior courts that relates to higher maximum penalties on indictment. A discount of 25% for a plea of guilty is the normal discount and should be applied unless there is good reason to depart from it.
