Whether Crown land is 'held' for a public purpose under s 6.26(2)(a)(i) of the Local Government Act 1995 (WA) is determined solely by examining the terms of the tenure documents (lease, Order in Council, statutory framework), without reference to evidence of actual use. A yacht club that confines use of land to its members does not use the land for a 'public purpose', even where membership is relatively accessible and the club is a non-profit incorporated association. A reservation for public pedestrian access over part of leased Crown land does not make the land non-rateable where the predominant and primary use remains as a private club.
