Section 68 of the Judiciary Act 1903 (Cth) is constitutionally valid and does not involve an impermissible delegation of Commonwealth legislative power. Differences in State committal procedures do not render s 68 invalid on equality grounds. Public committal proceedings and a magistrate's expression of opinion under s 65 of the Criminal Procedure Act 1986 (NSW) do not negate the right to a fair trial, as any concerns can be addressed by judicial directions to the jury.
