There is no general rule that a buyer of land will recover loss of profit on a resale; the purchaser must go beyond proving resale was one of a range of foreseeable outcomes and show the vendor had actual or imputed knowledge of the intended use. The market for development land builds future development potential into present value, making the difference between market and contract price the appropriate measure. A purchaser who validly terminates for the vendor's breach may nonetheless be required to mitigate by accepting the vendor's offer to complete, and refusal to do so may defeat a claim for consequential loss.
