A trial judge's adverse credit findings may be set aside on appeal where the objective evidence in the transcript does not support the findings, even where the trial judge had the advantage of seeing and hearing the witnesses. The right to compensation for loss of gratuitous domestic services under the Compensation to Relatives Act 1897 does not depend on the claimant's need for such services. A substantial delay between hearing and judgment delivery undermines reliance on demeanour as a basis for credit findings. In wrongful death damages cases, the general rule that inheritance of the matrimonial home is not deducted does not necessarily extend to business assets, and the facts must be examined to determine whether accelerated inheritance should be brought into account.
