A treating specialist who prescribes radical, experimental and controversial treatment based substantially on a specific protocol has a duty to ensure he or she has the most up-to-date version of that protocol, and cannot rely on the assumption that colleagues will pass on relevant information. A defendant's rejection of a Calderbank offer may be found unreasonable where the defendant knew of the evidence supporting the plaintiff's case at the time of the offer.
