In defamation proceedings involving radio broadcasts, a plaintiff is not obliged to plead additional material broadcast later in the same program unless it can and must reasonably be regarded as part of one publication with the material relied upon. The transient nature of radio broadcasts, significant time intervals between segments, unrelated intervening content, and the absence of linking factors or indications of unity between segments are key considerations. Material excluded from the matter complained of remains available to a defendant to tender in support of qualified privilege defences.
