Payments made by an insurer under s 45 of the Motor Accidents Act 1988 (NSW) should be deducted from the damages assessment before the reduction for contributory negligence, not after. The implied representation arising from a safety inspection certificate is limited to the scope of the inspection required by the rules for authorised inspection stations, is directed to the vehicle owner only, and is temporally limited to the date of inspection.
