Where a home warranty insurance policy contains an internal inconsistency between the operative indemnity provisions (Part A) and the Schedule regarding the temporal scope of coverage, primacy is given to the operative provisions as the part calculated to carry into effect the real intention of the parties. A policy obtained for the purpose of covering specific identified building work, with the premium calculated to include that work, will be construed as covering that work even if the building contract pre-dates the policy period stated in the Schedule. Part B 'run-off' provisions do not operate as a limitation on Part A coverage.
