A successful appellant is entitled to costs of the appeal in the ordinary course, even where the court does not fully accede to the appellant's position on the re-exercise of the discretion below. Partial success on the re-exercise of discretion does not constitute exceptional circumstances warranting departure from the usual costs order. Recognised exceptions include where the appellant loses on a separate issue that increased hearing time, or where a Calderbank offer was made.
