The 'just and reasonable' test from the Limitation Act has no application to extensions of time under s 109 of the Motor Accidents Compensation Act 1999 (NSW); the correct test is whether a 'full and satisfactory explanation' has been provided under s 109(3)(a). Deficient initial legal advice, prompt remedial steps by subsequent solicitors, and lack of cooperation from the opponent and its insurers can together constitute a full and satisfactory explanation for delay. The determination of whether a full and satisfactory explanation has been given is a normative judgment, not a House v The King discretion, and an appellate court may intervene if the finding was not fairly open on the evidence.
