A trial judge errs in ordering indemnity costs merely because a Calderbank offer was not accepted and the offeree ended up worse off. The court must consider all the circumstances and determine whether the failure to accept the offer warrants departure from the ordinary costs rule. Indemnity costs do not flow as a matter of course from an unaccepted Calderbank offer.
