A sentencing judge's failure to explicitly advert to each applicable factor in s 21A(2) and (3) of the Crimes (Sentencing Procedure) Act 1999 is not of itself a breach of s 21A; compliance must be assessed from the reasons as a whole. Failure to quantify the discount for a guilty plea does not warrant appellate intervention where the reasons and sentence level indicate an appropriate discount was given. When assessing manifest excessiveness of sentences that are partially concurrent with existing sentences, the practical impact on the offender is a relevant consideration.
