A trial judge has no power to direct a jury to make particular findings on provocation or to make special recommendations in favour of the accused. Where a jury rejects the accused's account of events and accepts the Crown case as to timing of death, the jury is entitled to conclude that alleged provocative conduct did not occur. Defence counsel's failure to raise self-defence does not constitute incompetent representation where the accused's own account does not support that defence.
