Section 27(b) of the Mental Health (Criminal Procedure) Act 1990 (NSW) confers power to order both detention and the place of detention, not merely the latter. The word 'may' in s 27 confers a genuine discretion on the court as to whether to make any order. A court cannot order that only part of a limiting term be served in detention, as this would subvert the review provisions in Part 2 of Chapter 5 of the Mental Health Act 1990 (NSW). The Court of Criminal Appeal has inherent power to correct accidental omissions in its orders.
