A sentence of 8 years (non-parole period of 5 years) for warehousing 19 firearms for sale to criminals under s 52D(2) of the Firearms Act 1996 (NSW) was held to be well within the sentencing range and possibly low. The maximum penalty of 20 years reflects the critical role that firearms warehousing plays in enabling violent crime. Comparable sentences under earlier or different firearms provisions with lower maximum penalties are of little assistance in sentencing under s 52D(2).
