Where a sentencing judge errs in calculating pre-sentence custody, the appropriate correction on appeal is to adjust the commencement date of the relevant sentence rather than to backdate the entire sentence where the latter would nullify the sentencing judge's intended accumulation structure. A sentencing judge who finds special circumstances arising solely from the accumulation of sentences is not required to adjust the non-parole period beyond what is necessary to restore the statutory ratio. To establish that protective custody should mitigate sentence, the court must be satisfied that the sentence will in fact be served in more onerous conditions than those of the general run of prisoners.
