Section 50(1) of the Crimes (Sentencing Procedure) Act 1999 (NSW) operates so that when a court imposes a sentence of imprisonment for a term greater than 3 years, the court itself should not make a parole order; the question of parole is left to the relevant parole authority. Where an offender completes one offence (armed robbery) and then makes a deliberate choice to embark upon fresh criminal conduct (sexual offences) rather than flee, the offences are properly treated as separate criminal episodes justifying accumulation of sentences.
