Section 31(1) of the Financial Transaction Reports Act 1988 (Cth) creates a single offence constituted by 'two or more non-reportable cash transactions'; the Crown need not prove all particularised transactions but only that at least two satisfy the section, provided the jury is unanimous as to the same two. The 'reasonable to conclude' standard in s 31(1)(b) is the standard of proof for the purpose element and is not displaced by s 141(1) of the Evidence Act 1995 (NSW), because the State Evidence Act applies in federal jurisdiction by virtue of s 79 of the Judiciary Act 1903 (Cth) only to the extent that no other Commonwealth law otherwise provides. For insider trading, the definition of 'information' in s 1002A includes intention that may be inferred from conduct, and the inference need not be the only reasonable inference available; information is not 'generally available' merely because particular aspects of it are generally available.
