A prosecutor's duty extends to calling relevant witnesses but not to obtaining statements from them. A stop work order under s22D of the Rivers and Foreshores Improvement Act 1948 must specify the particular activity to be ceased and cannot validly require cessation of 'all works' when the statute only authorises orders with respect to excavation or removal of material. A landowner who gives possession of a site for the purpose of excavation thereby causes or allows the excavation; whether the owner has ceded control is relevant only to the statutory defence.
