A single occasion of deemed supply of a prohibited drug does not amount to trafficking, and a sentencing judge is not constrained to impose a full-time custodial sentence unless exceptional circumstances are shown. The principle that only exceptional circumstances justify a non-custodial sentence applies to trafficking (connoting supply on more than one occasion or involvement in dissemination), not to isolated technical supply. When applying the parity principle, a sentencing judge must have regard to the full circumstances of the co-offender's sentence including the remarks on sentence.
