When a sentence does not reflect actual periods of custody or quasi-custody served (such as pre-sentence custody, Drug Court sanctions, or residential rehabilitation), the non-parole period must be adjusted to ensure the actual ratio between minimum custody and total custody reflects the sentencing judge's intention. Participation in a Drug Court programme is not equivalent to imprisonment and cannot be taken into account mathematically; it is merely a factor in the sentencing synthesis. Voluntary intoxication at the time of offending does not mitigate objective seriousness and may aggravate it where the offender knew drug use was likely to lead to offending.
