The precautionary principle requires two conditions precedent before it is triggered: (1) a threat of serious or irreversible environmental damage, and (2) scientific uncertainty as to the environmental damage. Where RF EME emissions from a proposed telecommunications facility comply with the Australian Standard RPS3, the first condition is not satisfied and the precautionary principle is not triggered. Community fears about health effects that are unsubstantiated and without reasonable evidentiary foundation cannot constitute an adverse impact on amenity or the public interest warranting refusal of a development application. A consent authority that refuses consent on the basis of such fears acts arbitrarily and contrary to principles of proper administrative decision-making.
